Privacy Policy
KING AVE PTY LTD (ABN 46 670 916 962, ACN 670 916 962) ("KING AVE", "we", "us" or "our") respects your privacy. This Privacy Policy explains how we collect, use, store and disclose personal information when you visit kingave.co, contact us, or use any app, game, video channel or other product or service we publish (together, our "Services").
We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and, where they apply to you, other privacy laws such as the EU and UK General Data Protection Regulation (GDPR).
1. Information we collect
Information you give us
- Contact details and messages, such as your name, email address and the content of any email or support request you send us.
- Business details if you work with us as a partner, client, contractor or supplier, such as your company name, role, and payment or invoicing details.
- Feedback and submissions you choose to send us, such as story ideas, comments or survey responses.
Information collected automatically
- Website server logs. Like most websites, our hosting provider automatically records technical information when you visit, such as your IP address, browser type, device type, pages requested and the date and time of the request. These logs are used for security and to keep the site running.
- App diagnostics and usage data. Some of our apps may collect limited technical data, such as crash reports, performance data, device type, operating system version and how features are used. Where possible this is collected in a form that does not identify you, and it is described in the app's App Store privacy details.
Information from third parties
- App stores and payment providers. If you download an app or make an in-app purchase, Apple (or another platform operator) processes your payment and account details. We do not receive your full payment card details. We may receive limited information such as transaction confirmations, aggregated sales reports and anonymised analytics.
- Video and social platforms. If you interact with our content on platforms such as YouTube, TikTok or Instagram, those platforms may share aggregated or de-identified audience statistics with us. Your use of those platforms is governed by their own privacy policies.
We do not knowingly collect sensitive information (such as health information, racial or ethnic origin, or religious beliefs). Please do not send it to us.
2. How we use your information
- to respond to your enquiries and provide support;
- to provide, maintain, secure and improve our website, apps and content;
- to diagnose technical problems and fix bugs;
- to process transactions and manage business relationships;
- to comply with our legal obligations and enforce our terms; and
- for any other purpose you have consented to, or which you would reasonably expect.
Where the GDPR applies, we rely on the following legal bases: performing a contract with you, our legitimate interests in running and improving our Services, complying with legal obligations, and your consent (which you can withdraw at any time).
We do not sell your personal information, and we do not use it to track you across other companies' apps or websites for advertising.
3. Direct marketing
We will only send you marketing messages if you have agreed to receive them or where otherwise permitted by law, including the Spam Act 2003 (Cth). Every marketing email will include a way to unsubscribe, or you can email privacy@kingave.co.
4. When we share information
We only share personal information as needed for the purposes above, with:
- Service providers who help us operate, such as website hosting, email, cloud storage, crash reporting and accounting providers. They may only use your information to provide services to us.
- Platform operators such as Apple, where needed to distribute our apps and process purchases.
- Professional advisers such as lawyers and accountants.
- Authorities where required or authorised by law, or to protect our rights, our users or the public.
- A buyer or successor if our business, or part of it, is sold or restructured, in which case your information would remain protected by this policy.
5. Overseas disclosure
Some of our service providers store or process data outside Australia, including in the United States and the European Union. When we disclose personal information overseas, we take reasonable steps to make sure the recipient handles it in a way that is consistent with the Australian Privacy Principles.
6. Storage and security
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. These include using reputable providers, encrypted connections (HTTPS), access controls and two-factor authentication on our accounts. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
We keep personal information only for as long as we need it for the purposes described in this policy or as required by law (for example, tax records), and then securely delete or de-identify it.
7. Cookies
This website does not use advertising, tracking or analytics cookies. If we introduce them in future, we will update this policy and, where required, ask for your consent first. Our pages load fonts from Google Fonts, which means your browser connects to Google's servers and Google receives your IP address; see Google's privacy policy for details.
8. Children
Our website is not directed at children. Some of our entertainment content may be suitable for younger audiences, but we do not knowingly collect personal information from children under 13 (or the equivalent minimum age in your country) without verifiable parental consent. If you believe a child has sent us personal information, please contact us and we will delete it.
9. Your rights
You can ask to access the personal information we hold about you, and to correct it if it is inaccurate, out of date or incomplete. Depending on where you live, you may also have the right to ask us to delete your information, restrict or object to how we use it, or receive a copy of it in a portable format.
To make a request, email privacy@kingave.co. We may need to verify your identity first. We will respond within 30 days and will not charge you for making a request. If we refuse a request, we will tell you why.
If an app you use lets you create an account, you can request deletion of that account and its associated data through the app or by emailing us.
10. Complaints
If you have a concern about how we have handled your personal information, please contact us first at privacy@kingave.co. We will acknowledge your complaint and aim to resolve it within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au. If you are in the EU or UK, you may also contact your local data protection authority.
11. Third-party links and platforms
Our Services may link to, or be available on, third-party websites and platforms (such as the App Store, YouTube and social media). We are not responsible for their privacy practices, and we encourage you to read their privacy policies.
12. Changes to this policy
We may update this Privacy Policy from time to time. The latest version will always be on this page with its effective date. If we make significant changes, we will take reasonable steps to let you know.
